On July 16, 2010 an Alameda County jury ruled in favor of defendant Doc Bailey Construction Equipment Inc., following a two week trial. Shareholder William Kronenberg conducted the defense for Doc Bailey in the action brought by the parents of decedent Alfredo Roman. The case arose from a tragic accident on July 14, 2006 when Mr. Roman, a 38 year old tree trimmer employed by the City of Oakland, fell to his death from the bucket of an aerial lift while cutting branches. The Plaintiff brought suit against the lift manufacturer, the certification company and Doc Bailey, who had performed maintenance on the lift on three prior occasions in 2005 and 2006. All of the defendants settled with Plaintiff prior to trial, except for Doc Bailey.
This verdict is the fourth defense award for Mr. Kronenberg in 2010, following defense verdicts in San Diego County, Los Angeles County, and Ventura County. Mr. Kronenberg has tried 5 wrongful death actions to verdict in California and Texas, and maintains an active trial practice involving catastrophic injury cases.
