The Honorable Wynne Carvill of the Alameda County Superior Court has issued a Statement of Decision in favor of MPB & F client Dazey Corporation following a court trial in an express contractual indemnity action.
MPBF shareholder William Kronenberg represented Dazey Corporation which had manufactured a hairdryer that was alleged to have caused an apartment file in Oakland. One resident died of smoke inhalation and another suffered serious injuries jumping from a second story window.
The case settled for 1.4 million dollars and Dazey thereafter brought suit against Helen of Troy based on a Purchase and Sale Agreement which contained a disputed indemity provision. After considering the evidence, Judge Carvill ruled in favor of Dazey and awarded the full amount of it's indemnity payment, attorneys fees and interest, totalling approximately $850,000. Following the Statement of Decision, the case settled for full payment of the awarded amount.
