- January 11, 2008 —
On January 11, 2008, the San Francisco Superior Court granted summary judgment for Burning Man event promoter Black Rock City, LLC, in a case filed by Anthony Beninati, who attended the Burning Man festival in 2005. (Beninati v. Black Rock City, San Francisco Superior Court case no. CGC-06-455768.) Mr. Beninati walked into the Burning Man bonfire, tripped and fell, and incurred severe burn injuries. Under California’s primary assumption of the risk doctrine, the court found that Black Rock City owed no duty of care to the plaintiff, finding that if he had simply chosen to stay away from the fire, he never would have burned himself. William S. Kronenberg and Steven A. Kronenberg (no relation) defended Black Rock City, LLC.
- April 9, 2008 —
William Muñoz from Murphy, Pearson's Sacramento office prevailed on appeal before the California Third District Court of Appeal.
The court affirmed the trial court's order granting Mr. Muñoz's client a nonsuit in a legal malpractice action entitled Kubat v. Henderson.

Greg Bastian and Robert Lucas of the Sacramento office have successfully defended a car dealer against allegations that the dealer committed fraudulent business practices that violated both the Consumer Remedies Legal Act and Automobile Sales Finance Act when the dealer assigned a retail installment sales contract to a bank at a different interest rate than set forth in the contract.

- January 31, 2008 —
Janet Everson and Kelly Fair of the firm's San Francisco office successfully
defended claims of discrimination based on disability by way of the California
anti-SLAPP statute (Strategic Lawsuits Against Public Policy). The firm's client
is a 107 unit, nonprofit, low-income housing cooperative whose membership pays
subsidized rents pursuant to Federal law and the rules and regulations of the U.S.
Department of Housing and Urban Development. Certain residents of the cooperative
were in violation of the cooperative's policies regarding pet ownership. After failed
efforts to informally resolve the dispute with the residents, the housing cooperative
sought to evict the residents through an unlawful detainer action. In response, the
residents filed suit claiming discrmination based on disability. Through a special motion
to strike, the residents' claims of discrimination were eliminated on the basis that the
housing cooperative's actions in pursuing their eviction remedies through the court
system were privileged acts under the California Litigation Privilege which protects
parties from retaliatory lawsuits arising out of statements made in, or actions taken
relative to, a judicial proceeding.

- January 24, 2008 —
William Munoz, a partner in Murphy, Pearson, Bradley & Feeney's Sacramento
office recently prevailed on appeal before the California Third District
Court of Appeal wherein the Court affirmed the trial court's order granting
Mr. Munoz's client a nonsuit in a legal malpractice action entitled Kubat v.
Henderson. The lawsuit arose from the sale of real estate in South Lake Tahoe
as part of a settlement in the underlying elder abuse and conversion action
where attorney Henderson represented the Kubats, who were the defendants in
the underlying matter. The Kubats contended that they were coerced into the
underlying settlement resulting in the sale of the family residence below market
value. The trial court granted Henderson's motion for nonsuit after the Kubats
could not establish any damages as a result of the alleged malpractice.

Michael Bradley was inducted as a fellow in the American College
of Trial Lawyers at a ceremony in London, England. ACTL is a highly
selective organization of trial lawyers limited to no more than
one percent of the trial lawyers in a given location. Only after
extensive review of a candidate's career by contacting lawyers who
have worked with and against the candidate, and judges in front of
whom the candidate has tried cases, is the position of fellow in
this College extended.
- August 3, 2006 —Jim Murphy and
Janet Everson successfully defended a law firm sued for malpractice involving
an underlying copyright infringement case. In an 11-1 verdict a San Francisco
jury determined that the Anolick Law Firm was not negligent in the
representation of Leon Rader and his company Art in Stone in a lawsuit
brought by them against several individuals and companies who allegedly
copied designs of cemetery monuments created by Rader. In addition the
jury awarded to the Anolick Law Firm all of the outstanding fees and costs
owed to it in the representation of Rader in the underlying case. The jury
trial was presided over by Judge Thomas Mellon Jr. of the San Francisco
Superior Court.

Timothy Halloran with Murphy, Pearson, Bradley & Feeney
successfully argued to the court that an Order granting
summary judgment based upon the doctrine of judicial estoppel was properly
granted.

Defense Verdict in Wrongful Death Case. On May 12, 2006 an
Alameda County jury found in favor of West Coast Security and
Patrol, Inc., and James Simon in a wrongful death case following
an altercation between a security guard and David Adams on
December 13, 2002. William Kronenberg defended West Coast and
Simon in the 2 week trial brought by the decedent's daughter
Christina Adams. The case was premised on claims of negligence
and negligent hiring before the Honorable Cecilia Castellanos.
The plaintiff was represented by R. Lewis Van Blois and Thomas
Knowles of Van Blois and Associates. Mr. Kronenberg, a
shareholder with the firm, was assisted during trial by his
associate, Steven Kronenberg. ( no relation )
